Aklti Terms of Use

1. About these Terms

1.1. These Terms of Use (the "Terms") are an agreement between you and KALM L.L.C-FZ, trade licence no. 2314694.01 (Meydan Free Zone, Dubai), Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E. ("Aklti", "we", "us"), for the use of the Aklti (أكلتي) mobile app and its related services (the "Service").

1.2. By accepting these Terms in the App, you agree to them. If you do not agree, do not use the Service.

1.3. Our Privacy Policy explains how we process your data, including health data, and forms part of these Terms. Health data and AI processing each need a separate consent, which the App asks for.

2. Definitions

2.1. "Estimate": any number, range, target, answer or suggestion produced by the Service, including nutritional values, portions, daily targets, calories burned and the "does it fit me?" check.

2.2. "AI Features": the optional features that send a meal photo, description or dish name to an outside AI provider to recognise foods and amounts.

2.3. "Your Content": what you enter or upload: profile data, health answers, food profile, meals, descriptions, notes, photos, dish names and exercise.

3. Who may use Aklti

3.1. The Service is for adults aged 18 or over. By using it you confirm that you are 18 or older. The App will not create a profile for a date of birth under 18.

3.2. You must give accurate information, especially your date of birth, body measurements and health answers, because the Service's safety rules depend on them.

3.3. One account per person. Your account is personal and may not be shared or transferred.

4. Your account

4.1. You sign in with a one-time code sent to your email address. Keep access to your email secure: anyone who can read your email can sign in to your account.

4.2. You are responsible for activity on your account. Tell us at support@aklti.app if you think someone else has used it.

5. What the Service does

5.1. Aklti lets you log meals (by searching the food database, describing the meal in words or taking a photo), see estimated nutritional values, set an estimated daily target, check meals against the diet and food groups you avoid, log exercise, save your own dishes, earn badges and set meal reminders on your phone.

5.2. How values are calculated: nutritional values come from Aklti's food database, which is based on documented sources (including the U.S. Department of Agriculture's FoodData Central SR Legacy, public domain), and on foods curated by Aklti. The AI never calculates values; it only recognises foods and amounts. Each food shows its source and whether it has been reviewed.

5.3. Provisional targets: daily targets use a published equation (Mifflin-St Jeor) and safety limits that a dietitian reviewed. They are still marked "provisional" until the dietitian reviews the App itself, and the App says so.

6. Health disclaimer — please read carefully

6.1. Aklti is a tool to help you follow what you eat and your nutrition. It does not replace a doctor or a dietitian, and it gives no diagnosis, treatment or medical advice. It is not a medical device.

6.2. All Estimates are general information and can be wrong or incomplete. Portions from photos and descriptions are approximate; values are shown as ranges; nutrient data for a food can differ from what you actually ate (recipe, brand, cooking). You are responsible for checking them, and the ingredients of your food, before relying on them, especially with an allergy or an illness.

6.3. Food-group warnings are hints, not guarantees. The App may say a food "contains" or "may contain" a group you avoid (for example gluten, nuts, dairy). It can miss a group. Never rely on Aklti alone to avoid an allergen; always check the label and ask the person who prepared the food.

6.4. If you have a health condition, are pregnant or breastfeeding, or take medicines, ask your doctor before changing what you eat. For your safety, with pregnancy, breastfeeding, diabetes treated with insulin or medicines that can lower blood sugar, kidney disease, or an eating disorder, the App does not set calorie targets or a weight-loss plan; with type 2 diabetes its numbers are general information to show your doctor; with some conditions therapeutic diet checks are paused.

6.5. Calories burned by exercise are an estimate from the activity and your weight, and are not added to your food target.

6.6. Aklti does not promise any weight loss or health result. Expected weight change is an average estimate, not a promise.

6.7. In an emergency, contact your local emergency services or a doctor immediately. Aklti is not monitored and cannot respond to emergencies. If you are struggling with eating, please talk to a doctor, therapist or dietitian.

7. AI Features

7.1. AI Features are optional and work only after you give the separate AI consent. You can withdraw it at any time in the App, under Settings → Privacy & data (see the Privacy Policy), and keep using the rest of the Service.

7.2. AI Features are provided through an outside provider (currently Claude, by Anthropic). Only the photo, its note, the description or the dish name is sent; your identity, profile and health answers are not.

7.3. AI output may be inaccurate. Nothing is saved to your diary until you review and confirm it. You can correct any item, amount or value before or after saving.

7.4. Do not send photos of people, documents, screens or anything other than food and drink, and do not write personal information about yourself or others in descriptions or notes.

7.5. Shared dish library: when the AI breaks a well-known dish into ingredients, the dish's name and ingredients (never your identity or your own amounts) are kept in Aklti's shared library and used for other users. You agree that this AI-generated recipe may be kept and used in this way.

7.6. AI Features have daily limits, and may be paused (for example when a monthly budget is reached, or the provider is unavailable). The free text parser and the food database remain available.

8. Plans, limits and payments

8.1. The Service is currently provided free of charge, on a free plan with daily limits (for example on the number of text and photo analyses). Limits are shown in the App and may change.

8.2. No paid plan is offered today.

8.3. Editing a logged item never uses up a limit.

9. Acceptable use

9.1. You agree not to:

• use the Service if you are under 18, or give false information about your age or health;
• use the Service for anyone other than yourself, or to provide medical, dietary or professional advice to others;
• upload unlawful, offensive or infringing content, or photos of other people without their consent;
• try to get around limits, access other users' data, probe, scan or test the security of the Service, or interfere with its operation;
• copy, scrape or extract the food database, the shared dish library or other content in bulk;
• reverse engineer the App except as allowed by law;
• use the Service to build a competing product, or to train AI models;
• use automated means (bots, scripts) to access the Service.

9.2. We may suspend or end access for breach of this clause, after notice where reasonable.

10. Your Content

10.1. Your Content remains yours. You give Aklti a limited, non-exclusive, worldwide, royalty-free licence to store and process Your Content only to provide the Service to you, as described in the Privacy Policy, for as long as your account exists (and for the retention periods stated there).

10.2. You confirm you have the right to upload Your Content, including photos.

10.3. Badge images you choose to share are created on your phone and shared by you through your phone's share sheet; you are responsible for what you share.

11. Intellectual property

11.1. The App, its design, the name and logo "Aklti / أكلتي", the curated food database, the shared dish library and the software belong to Aklti or its licensors.

11.2. We give you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your personal, non-commercial use, under these Terms and the App Store / Google Play rules.

11.3. Third-party data is used under its licence (for example USDA FoodData Central, public domain CC0). Open-source components are used under their licences.

12. App stores and third parties

12.1. If you downloaded the App from Apple's App Store: these Terms are between you and Aklti, not Apple; Apple has no obligation to provide maintenance or support; Apple is not responsible for any claim relating to the App (including product liability, legal compliance or intellectual property claims); Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

12.2. Google Play's terms also apply if you downloaded the App from Google Play.

12.3. The Service relies on third-party services (hosting, sign-in, AI, updates). We are not responsible for their own terms or interruptions outside our control.

13. Availability, updates and changes to the Service

13.1. We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. It may be unavailable for maintenance, updates or reasons outside our control.

13.2. The App may update itself automatically (over-the-air updates). Some features may need you to install a newer version.

13.3. We may add, change or remove features. We will tell you in advance of a material change that reduces the Service, where reasonable.

14. Disclaimer of warranties

14.1. To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, accuracy of Estimates, or that the Service will meet your health goals.

15. Limitation of liability

15.1. To the extent the law allows, Aklti is not responsible for any harm or health complication arising from using the App or relying on its information, or for indirect, incidental or consequential loss, loss of data or loss of profit.

15.2. To the extent the law allows, Aklti's total liability to you for any claim related to the Service is limited to the amount you paid Aklti in the 12 months before the claim.

15.3. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or gross negligence or wilful misconduct.

16. Ending these Terms and deleting your account

16.1. You can stop using the Service at any time and delete your account in the App, under Settings → Privacy & data → "Delete my account and data", or by writing to privacy@aklti.app. Deleting the account deletes your data as described in the Privacy Policy.

16.2. We may suspend or close your account if you seriously or repeatedly breach these Terms, if required by law, or if we stop providing the Service, with notice where reasonable.

16.3. Clauses that by their nature should survive (for example 6, 11, 14, 15, 18) survive the end of these Terms.

17. Changes to these Terms

17.1. We may update these Terms. Each version has a number and a date. For a material change, the App will show the new version and ask you to accept it before you continue; if you do not accept, you may delete your account.

18. Governing law and disputes

18.1. These Terms are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai.

18.2. Disputes will be settled by the courts of Dubai. Before going to court, please contact us at privacy@aklti.app so we can try to resolve the matter amicably within 30 days.

18.3. If you are a consumer, this does not deprive you of the protection of mandatory laws of your country of residence, or of the right to go to its courts where the law gives you that right.

19. General

19.1. Language: these Terms are provided in Arabic and English.

19.2. If any clause is found invalid, the rest remain in force.

19.3. Our failure to enforce a right is not a waiver of it.

19.4. You may not transfer your rights under these Terms. We may transfer ours to a successor, with notice to you.

19.5. These Terms, with the Privacy Policy and the consents you give in the App, are the entire agreement between you and Aklti about the Service.
